Terms & Conditions
Last Updated: October 2026
1. Agreement to Terms
By accessing our website, submitting an inquiry, or executing a Merchant Processing Agreement with Insight Merchant Solutions ("Insight", "we", "our", or "us"), you agree to be bound by these Terms and Conditions and all applicable operating rules, card brand regulations, and federal and state banking laws.
2. Merchant Processing Services
Insight provides merchant processing solutions, payment gateways, point-of-sale (POS) hardware, and surcharge/cash discount programs. All merchant applications are subject to underwriting and approval by our acquiring sponsor banks.
We operate as a registered Independent Sales Organization (ISO) of Wells Fargo Bank, N.A., Walnut Creek, CA; BMO Harris N.A., Chicago, IL; Citizens Bank N.A., Providence, RI; and The Bancorp Bank, Philadelphia, PA.
3. Zero Cost Processing Compliance
Merchants participating in the Cash Discount or Surcharging Program agree to adhere to all Visa, Mastercard, Discover, and American Express operating regulations. This includes posting clear signage at the point of sale, clearly delineating cash vs. credit card prices, and capping card brand surcharges within lawful regulatory limits (never exceeding 3% or applicable local state caps).
4. Month-to-Month Agreements & Rates
Standard agreements are month-to-month with no early termination fees or cancellation penalties, unless specifically stated in an enterprise equipment financing rider. Processing rates and interchange fees are based on the fee schedule set forth in your customized Merchant Processing Agreement.
5. Equipment & Terminals
Hardware supplied by Insight (including Dejavoo terminals, Clover POS units, and KwickPOS systems) remains subject to manufacturer warranty terms. Merchants are responsible for maintaining PCI-compliant terminal security and preventing unauthorized tampering or physical skimming.
6. High-Risk Merchant Accounts
Specialty high-risk accounts (including CBD, gaming, nutraceuticals, travel, firearms, e-commerce) may carry specific rolling reserve, chargeback monitoring, and volume parameters set by underwriting banks. Merchants agree to maintain chargeback ratios below card brand monitoring program thresholds (typically under 1%).
